1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the Zaqros communication platform, including the Zaqros website, customer portal, calling-card service, and related VoIP services (together, the “Service”). By creating an account, topping up a balance, or placing a call through the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility and account registration

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. You agree to provide accurate, current, and complete information at registration and to keep it updated. You are responsible for safeguarding your account credentials, calling-card PIN, and any activity that occurs on your account. Notify us immediately at hello@zaqros.com if you suspect unauthorised access.

3. Acceptable use

You agree not to use the Service to:

• Engage in any unlawful activity or violate the rights of others;
• Place fraudulent, harassing, threatening, or abusive calls;
• Generate artificial or automated traffic, telemarketing without consent, or robocalling in violation of applicable law;
• Attempt to bypass, tamper with, or probe the security of the Service or its underlying infrastructure;
• Resell or white-label the Service without a separate written reseller agreement with Zaqros;
• Circumvent rate plans, fraud controls, or usage limits applied to your account.

We may suspend or terminate your account immediately and without refund if we reasonably believe you have breached these rules.

4. Service availability and quality

Zaqros uses global VoIP infrastructure and third-party carriers to route your calls. While we work to provide reliable, clear voice connectivity, the Service is provided on a commercially reasonable “as available” basis. We do not guarantee uninterrupted service, specific audio quality, or successful completion of every call. Factors outside our control — such as your internet connection, carrier outages, local network restrictions, or government-imposed limitations on communications — may affect availability.

5. Rates, top-ups, and billing

Calls are billed at the rates posted on our pricing page, which may change from time to time. Rate changes are prospective only and will not affect balance already on your account for already-placed calls. Billing is per second from the moment the call connects, unless otherwise stated for a specific destination. Top-ups are paid through PayPal or another payment method we support, credited to your account balance, and are non-refundable except as required by applicable law.

You are responsible for maintaining a sufficient balance to place calls. When your balance reaches zero, calls will no longer connect until you top up again. Inactive accounts (no calls or top-ups for twelve consecutive months) may be closed with reasonable advance notice, and any remaining balance may be forfeited to the extent permitted by law.

6. Emergency services (E911 / 112)

Zaqros is not a replacement for a traditional landline or mobile telephone service. The Service does not provide access to emergency services such as 911, 112, or local equivalents. Do not rely on Zaqros for emergency communications. You should maintain an alternative means to contact emergency services at all times.

7. Regulatory and cross-border use

You are responsible for complying with the laws of your country and of the countries you call. Zaqros is designed to enable reliable communication across borders and in low-access regions, but nothing in this Service is intended to encourage you to violate applicable law. Availability of specific destinations or features may vary by region and may be changed or withdrawn at any time.

8. Intellectual property

The Zaqros name, logo, website, portal, documentation, and all related software are owned by Zaqros or its licensors and are protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, modify, reverse-engineer, or create derivative works, except as expressly permitted by law.

9. Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service you consent to the processing described there.

10. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

11. Limitation of liability

To the maximum extent permitted by law, Zaqros, its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with the Service. Our aggregate liability to you for any claim relating to the Service will not exceed the amount you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Zaqros and its affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right or applicable law.

13. Suspension and termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if continuing to provide the Service to you poses a security or fraud risk. Sections intended by their nature to survive termination — including billing, disclaimers, limitation of liability, and indemnification — will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, take reasonable steps to notify you (for example, by email or an in-portal notice). Your continued use of the Service after the update takes effect means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Zaqros is organised, without regard to its conflict-of-law principles. Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the competent courts of that jurisdiction, unless mandatory consumer-protection law requires otherwise.
